These terms govern your use of a WAHOA-hosted portal. They are between WAHOA and the homeowners association whose portal you access. Individual residents access the portal under terms set by their board.
What WAHOA is, and isn't
WAHOA is a software platform. We host portals, store documents, and manage user accounts. We are not a property management company, a law firm, or a fiduciary. We do not advise on HOA governance, dues collection, lien enforcement, or compliance with the Washington Uniform Common Interest Ownership Act (WUCIOA) or any other statute.
Your responsibilities
- Keep your password and authenticator device secure. Notify the board immediately if compromised.
- Use the portal only for purposes authorized by your board.
- Don't upload illegal content or material that infringes third-party rights.
Board responsibilities
The board is responsible for the content uploaded to its portal, the accuracy of any minutes, financials, or notices it publishes, and for maintaining an accurate roster of resident accounts. WAHOA does not review uploaded content.
Service availability
We aim for high uptime but provide no guaranteed SLA at base pricing tiers. The platform is hosted on Cloudflare Workers and inherits Cloudflare's availability characteristics.
Limitation of liability
To the maximum extent permitted by law, WAHOA's aggregate liability is limited to the amount your HOA paid to WAHOA in the twelve months preceding the claim. We are not liable for consequential, incidental, or indirect damages.
Termination
Either party may terminate the service agreement on 30 days' written notice. On termination, the board may export its documents and audit log; after 30 days, all data for the terminated HOA is purged.
Changes
We may update these terms. Material changes will be communicated to the board's primary admin at least 30 days before they take effect.
